Note that the line affected is in merge_patches_after_patch (line 807 in darcs
1.0.9rc1)

I tested the sample repos tonight and found that the bug is "resolved in
unstable". Converting one or both of the repos to a new format was not
necessary. Simply using a current version of darcs was all that was needed.
